Terms of Service

1. Acceptance of Terms

By accessing or using Linkpe ("Service"), operated by ADWARE TECHNOLOGIES PRIVATE LIMITED, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Linkpe is an automated selling platform built for WhatsApp and Instagram sellers in India. It enables sellers to create an online store, list products, and accept payments from customers automatically, replacing manual order management on WhatsApp. The Service includes:

• A hosted online store with a link (e.g. storename.mylinkpe.in)
• Product listing with variants, images, and pricing
• Customer checkout with cart, address collection, and automatic payment confirmation
• Order management dashboard with tracking and invoices
• Automated payment processing via your own Razorpay or Cashfree account (no manual screenshot verification)
• Shipping and courier management
• Store customisation including logo, colours, and custom domain

3. User Accounts

To use Linkpe, you must register for an account. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure and not share them
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorised access at support@mylinkpe.in

4. Seller Obligations

As a seller on Linkpe, you agree to:

• Only list and sell lawful products and services
• Provide accurate product descriptions, images, and pricing
• Fulfil orders promptly and handle customer queries honestly
• Not misrepresent your identity or business
• Not use the Service for any fraudulent, illegal, or abusive purpose
• Not attempt to circumvent platform fees or payment infrastructure
• Handle customer refunds and cancellations as per your stated policies

5. Payment Processing

Linkpe facilitates automated payment collection through third-party gateways. Payments are processed by RBI-certified, PCI-DSS Level 1 compliant providers. You acknowledge that:

• You connect your own Razorpay or Cashfree account. 100% of every payment settles directly to your gateway-linked bank account. Linkpe takes 0% commission.
• Customer card and UPI credentials are handled exclusively by your payment gateway and never pass through Linkpe's servers.
• You are responsible for resolving payment disputes with your customers.
• Linkpe is not liable for failed, delayed, or disputed transactions caused by gateway issues or customer error.

6. Free Trial and Subscription

Every new account receives a 30-day free trial with full access to all Linkpe features. No payment details are required to start the trial.

• Free Trial (30 days): Full access to all features. 0% commission. You connect your own payment gateway and receive 100% of every sale.
• Paid Subscription (₹699/month): Continues all features after the trial ends. 0% commission. Subscription fees are billed in advance and are non-refundable except as described in the Refund Policy.

When your trial ends and no active subscription is in place, your store will be temporarily paused. Customers will not be able to place new orders. Your products, orders, and data remain intact and your store will be reactivated immediately upon subscribing.

Store data is retained for 90 days after the trial ends. If no subscription is activated within this period, all store data including products, orders, customer information, invoices, and uploaded images will be permanently deleted. You will receive an email warning 15 days before deletion. Subscribing before the 90-day window closes will restore your store and all data immediately.

We reserve the right to modify pricing with 30 days' notice. Continued use after a pricing change constitutes acceptance of the new rates.

7. Content and Intellectual Property

You retain ownership of the content you upload to Linkpe (product photos, descriptions, business information). By uploading content, you grant Linkpe a limited, non-exclusive licence to display and distribute it solely to provide the Service.

All intellectual property in the Linkpe platform, including the software, design, trademarks, and branding, belongs to ADWARE TECHNOLOGIES PRIVATE LIMITED.

8. Data and Privacy

Your use of the Service is governed by our Privacy Policy. By using Linkpe, you consent to the collection and use of information as described therein.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ADWARE TECHNOLOGIES PRIVATE LIMITED shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or technical failures
• Actions or inactions of third-party payment gateways or shipping providers
• Disputes between sellers and their customers

10. Termination

We may terminate or suspend your account without prior notice if you breach these Terms, engage in fraudulent or illegal activity, or the account remains inactive for an extended period. You may delete your account at any time through your dashboard settings.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

12. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes via SMS or a notice within the Service. Continued use after changes constitutes your acceptance of the updated Terms.
